Quotations provided by Cat Mount Rubbercom are valid for 30 days from the issue date unless otherwise specified. Quotations are not binding offers but rather invitations to negotiate. A binding contract is formed only when we accept your purchase order through written confirmation.

Order Acceptance

All orders are subject to acceptance by Cat Mount Rubbercom. We reserve the right to refuse or cancel any order for any reason including product availability, errors in pricing or product information, suspected fraud, or other reasons at our sole discretion. If your order is canceled after payment, we will issue a full refund.

Minimum Orders

Certain products may have minimum order quantities. Custom products may require minimum tooling investments and production quantities. These requirements will be communicated during the quotation process.

4. Pricing and Payment

Pricing

All prices are quoted in US Dollars (USD) or Turkish Lira (TRY) as specified and are subject to change without notice. Prices exclude shipping costs, insurance, customs duties, taxes, and other charges unless explicitly stated otherwise. Final pricing will be confirmed in written quotations and order confirmations.

Payment Terms

Payment terms are established at the time of order confirmation and may include:

Advance payment (wire transfer or credit card) for new customers or small orders
Letter of Credit (LC) for large orders or as agreed
Credit terms for approved customers with established payment history

Payment must be received before shipment unless credit terms have been approved.

Currency and Exchange Rates

For international transactions, currency exchange rates may fluctuate between quotation and payment. Unless otherwise agreed, the exchange rate applicable on the payment date will apply.

5. Shipping and Delivery

Shipping Terms

Shipping is governed by Incoterms 2020 as specified in the order confirmation. Common terms include EXW (Ex Works), FOB (Free On Board), CIF (Cost, Insurance, Freight), and DDP (Delivered Duty Paid). Responsibilities and risk transfer are defined by the agreed Incoterm.

Delivery Times

Delivery estimates are approximate and not guaranteed. Actual delivery times depend on product availability, production schedules, shipping methods, customs processing, and other factors beyond our control. We are not liable for delays in delivery.

Shipping Risks

6. Inspection and Returns

Inspection Upon Delivery

Customers must inspect products upon delivery and report any visible damage, shortages, or discrepancies within 7 days of receipt. Failure to report issues within this timeframe may limit remedy options.

Return Policy

Returns of standard catalog products may be accepted within 30 days of delivery subject to the following conditions:

Products must be unused, uninstalled, and in original packaging
Prior written authorization from Cat Mount Rubbercom is required
Return shipping costs are borne by the customer unless the return is due to our error
Restocking fees may apply

Custom-manufactured products, special orders, and products modified per customer specifications are non-returnable and non-refundable unless defective.

7. Warranties

Product Warranty

Cat Mount Rubbercom warrants that products manufactured by us will be free from defects in materials and workmanship under normal use and service for a period of 12 months from the date of shipment or as otherwise specified in writing. This warranty does not cover:

Normal wear and tear
Damage from improper installation, maintenance, or use
Damage from accident, misuse, abuse, or modification
Damage from exposure to conditions beyond product specifications
Products purchased from unauthorized distributors

Our sole obligation under this warranty is to repair or replace defective products or refund the purchase price, at our sole discretion. This warranty is exclusive and in lieu of all other warranties, express or implied.

EXCEPT AS EXPRESSLY STATED ABOVE, CAT MOUNT RUBBERCOM MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that products will meet your specific requirements or that operation will be uninterrupted or error-free.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAT MOUNT RUBBERCOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising out of or related to these Terms or products shall not exceed the purchase price paid for the specific products giving rise to the claim.

These Terms are governed by the laws of Turkey without regard to conflict of law provisions. Any disputes arising from these Terms or product transactions shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts in Ankara, Turkey.

International Transactions

For international transactions, the United Nations Convention on Contracts for the International Sale of Goods (CISG) may apply unless expressly excluded in writing.

13. Modifications to Terms
